Daywell Creative, LLC ("Daywell," "we," "us," or "our") respects your privacy and is committed to protecting it through this Privacy Policy. This policy explains what information we collect through daywellcreative.com (the "Site"), how we use it, and the choices you have. By using the Site, you agree to the practices described below.

This policy is written to cover our current practices as well as tools we may add in the future (such as website analytics or email marketing), so some sections describe optional or planned uses rather than things that are active today. Where that's the case, we've noted it.

1. Information We Collect

Information you provide directly:

  • Contact and intake forms. When you reach out through our contact form or project intake form (currently powered by Tally), we collect the information you submit– typically your name, email address, business name, and details about your project or inquiry.

  • Payment information. If you make a payment through our website, your payment is processed by a third-party payment processor. We do not store your full credit card or bank account numbers anywhere on our own servers.

  • Communications. If you email us, book a call, or otherwise correspond with us, we retain that correspondence as part of our normal business record-keeping.

Information collected automatically (currently not in use, may be added in the future):

  • Analytics. We may use website analytics tools (such as Google Analytics) to understand how visitors use our Site — for example, which pages are viewed and how long visitors stay. These tools may use cookies and collect information such as your IP address, browser type, device type, and general location.

  • Cookies. If we implement analytics or marketing tools, they may place cookies or similar tracking technologies on your device. You can control cookies through your browser settings.

Information collected if you opt in to email marketing (currently not in use, may be added in the future):

  • If we offer a newsletter or email list signup, we will collect your name and email address, and use a third-party platform to send communications. You may unsubscribe at any time via the link in any email.

2. How We Use Your Information

We use the information we collect to:

  • Respond to inquiries and provide quotes or proposals

  • Deliver contracted design and branding services

  • Process payments and maintain financial and business records

  • Communicate with you about your project, invoices, or account

  • Improve our Site and services (if analytics tools are in use)

  • Send marketing communications, only if you've opted in (if email marketing tools are in use)

  • Comply with legal, tax, and accounting obligations

We do not sell your personal information to third parties.

3. How We Share Information

We share information only as needed to operate our business:

  • Service providers. We use trusted third-party tools to run our business, which may include Tally (form submissions), Notion (project and client management), Google Workspace (email and file storage), and a payment processor (Squarespace Payments). These providers process data on our behalf and are bound by their own privacy and security practices.

  • Legal requirements. We may disclose information if required by law, subpoena, or to protect the rights, property, or safety of Daywell, our clients, or others.

  • Business transfers. If Daywell is ever involved in a merger, acquisition, or sale of assets, client and site information may be transferred as part of that transaction, subject to this policy or a comparably protective one.

We do not share client project details, brand strategy work, or confidential materials outside of what's needed to deliver services, consistent with the confidentiality terms in our client agreements.

4. Payment Processing

Payments made through our Site are handled by a third-party payment processor (Squarespace Payments). That processor collects and stores your payment details directly under its own privacy policy and security standards (such as PCI-DSS compliance). Daywell does not have access to your full payment card details.

For clients who pay via invoice outside the Site (e.g., bank transfer or check), those payments are handled according to the terms in your signed Project Proposal or Creative Services Agreement.

5. Data Retention

We retain personal information for as long as necessary to:

  • Fulfill the purpose for which it was collected (e.g., completing a project)

  • Meet our contractual, legal, tax, and accounting obligations

  • Maintain business records consistent with standard practice

Project files, contracts, and invoices are generally retained for at least 1 year to comply with tax and business record-keeping requirements.

6. Your Choices and Rights

  • Opt out of marketing. You can unsubscribe from any email marketing at any time using the link in the email.

  • Access or correction. You can request a copy of the personal information we hold about you, or ask us to correct or delete it, by contacting us at hello@daywellcreative.com.

  • Cookies. If analytics or tracking tools are active, you can disable cookies through your browser settings, though some Site features may not work as intended.

  • Missouri and other state privacy laws. Depending on where you live, you may have additional rights regarding your personal information. Contact us and we'll do our best to accommodate applicable requests.

7. Children's Privacy

Our Site and services are intended for business use and are not directed at children under 13. We do not knowingly collect personal information from children.

8. Data Security

We take reasonable measures to protect the information we collect, including relying on reputable third-party platforms (Tally, Notion, Google Workspace, and Squarespace Payments) that maintain their own security standards. However, no method of transmission or storage is 100% secure, and we cannot guarantee absolute security.

9. Third-Party Links

Our Site may contain links to third-party websites (e.g., social media, client websites). We are not responsible for the privacy practices of those sites and encourage you to review their policies separately.

10. Changes to This Policy

We may update this Privacy Policy from time to time to reflect changes in our practices or for legal reasons. The "Last Updated" date at the top of this page will reflect the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the updated policy.
