Welcome to daywellcreative.com (the "Site"), operated by Daywell Creative, LLC ("Daywell," "we," "us," or "our"). By accessing or using the Site, submitting an inquiry, or engaging our services, you agree to these Terms of Service ("Terms"). If you do not agree, please don't use the Site.
These Terms govern your use of the Site itself. If you become a client, your project is governed by a signed Project Proposal and Creative Services Agreement— those documents control anything related to your engagement, deliverables, or payment terms.
1. Use of the Site
You agree to use the Site only for lawful purposes. You may not:
Use the Site for any unlawful purpose
Attempt to gain unauthorized access to the Site or our connected systems
Copy or reproduce Site content for commercial purposes without permission
Introduce viruses or anything intended to disrupt the Site
We may restrict access to anyone who violates these Terms.
2. Intellectual Property
All content on the Site — logo, copy, portfolio images, brand assets — is owned by Daywell Creative, LLC (or displayed with client permission) and may not be reproduced or used without our written permission.
Ownership of work created for clients is governed by the signed Creative Services Agreement, not by these Terms.
3. Inquiries, Proposals, and Engagements
Submitting a contact or intake form (via Tally) is an inquiry only– it does not create a binding agreement or guarantee availability.
Services begin only once a Project Proposal and/or Creative Services Agreement has been signed by both parties.
Package descriptions, pricing, and timelines shown on the Site are general and subject to change; your signed proposal reflects the final, binding terms for your project.
4. Payments
If you make a payment through the Site via our payment processor, Squarespace Payments, that transaction is handled by the processor under its own terms.
5. Third-Party Tools and Links
The Site relies on third-party tools (such as our forms provider and payment processor), which have their own terms. The Site may also link to third-party websites; we aren't responsible for their content or practices.
6. Disclaimers
The Site is provided "as is" without warranties of any kind. We don't guarantee it will be uninterrupted, error-free, or secure. Nothing on the Site is legal, financial, or professional advice.
7. Limitation of Liability
To the fullest extent permitted by law, Daywell Creative, LLC is not liable for indirect, incidental, or consequential damages arising from use of the Site. This limitation does not extend to services delivered under a signed Creative Services Agreement, which is governed separately by that agreement.
8. Governing Law
These Terms are governed by the laws of the State of Missouri. Disputes arising from use of the Site will be resolved in Missouri state or federal courts, unless otherwise specified in a signed client agreement.
9. Changes to These Terms
We may update these Terms from time to time. The "Last Updated" date at the top of this page will reflect the most recent revision. Continued use of the Site after changes take effect constitutes acceptance of the updated Terms.
